Terms & Conditions For Online Purchase – VK Furniture and Electronics.

WARRANTY POLICY:

VK Furniture & Electronics, a unit of VK Groups, having its registered address at Lobo Chambers, opp. Village Restaurant, Yeyyadi, Mangaluru, Karnataka 575008 (“VK Furniture & Electronics”, “we”, “us” or “our” VK) is managing and operating the E-Commerce platform www.vk-groups.com through which it inter alia facilitates the sale of its products (“Products”) to the users of the Platform (“User” or “you” or “your”).

Upon your acceptance of terms and conditions as set out under this policy (“Warranty Policy”), we provide this warranty to you that the Products will be free from manufacturing defects and defects in design and workmanship (“Warranty”).

1. Warranty Period: The Warranty for each product, along with a complete description of the product, will be listed on the product detail page. This Warranty Policy starts on the date of product delivery (“Warranty Period”).

Eligibility: To be eligible for this non-transferrable Warranty, you must present a valid invoice for the Product when requested by us or our representative(s). It is important to note that any modifications or alterations made to the products after purchase are not recommended and will result in the voiding of the entire Warranty.

2. VK Furniture and Electronics Responsibilities: Within the Warranty Period and in accordance with the conditions specified on the respective product details page, VK Furniture and Electronics has the discretion to undertake the following actions:

2. a. Repair: VK Furniture and Electronics may choose to repair the damaged product after verifying the exact reason for the damage. In the case of Electronic items, damage and technical fault will be fixed or repaired by the respected brand company under service warranty.

2. b. Replacement: VK Furniture and Electronics may opt to replace the damaged Product under following conditions.

(i)The Product is found damaged, (ii) Customer receives both the Product and shipping package with damage, (iii)If the Product is defective or not in working condition, (iv)While receiving the items, the parts of the Product or accessories are missing inside the box or pack, (v)The Product received is different from what was ordered based on the Product description provided on VK-Groups.

3. c. Refund: No cash refund except VK Furniture and Electronics has the option to refund the purchase price of the damaged Product to you, as per the following:

(i)The Product is damaged, (ii)Both the Product and shipping package have been damaged, (iii)The Product is defective or not in working condition, (iv)Parts of the Product or accessories are missing, (v)The Product received is different from what was ordered based on the Product description provided on VK-Groups.

Repair, Replacement and Refund Process

(a) Repair Process: If a damaged Product needs to be repaired under this Warranty, VK Furniture and Electronics will arrange for the pickup of the damaged Product from the original delivery address. After the repair, the repaired product will be delivered back to the original delivery address. However, VK Furniture and Electronics may, at its discretion and upon your request, agree to ship the repaired Product to an alternative address with certain delivery charges. In certain cases, our technical team may visit the customer's location to assess the extent of damage and provide on-site repair service.
(b) Replacement Process: If a damaged Product needs to be replaced under this Warranty, VK Furniture and Electronics will deliver the replacement Product to the address where the damaged Product was originally shipped. During the delivery of the replacement Product, However, VK Furniture and Electronics may, at its discretion and upon your request, agree to ship the replaced Product to an alternative address other than the original delivery address. Extra transportation charges will be applicable for the delivery place changes.
(c) Refund Process (If applicable): refunds for pre-paid orders will be credited to the same account used for the original order and payment of the Product(s). In order to process a valid refund claim under the Warranty Policy, the damaged Product must be successfully picked up by VK Furniture and Electronics.

4. Exclusions: This Warranty does not cover damages or defects resulting from the following: 1) Inadequate maintenance of the product 2) Mishandling or improper usage 3) Excessive loading beyond the product's recommended capacity. 4) Negligence in usage. Additionally, this Warranty does not cover normal wear and tear resulting from regular usage of the product, as well as any variations in appearance or performance due to the natural characteristics of the materials used. VK Furniture and Electronics reserves the right to make the final decision regarding the nature of the defect and the applicability of the Warranty.

If a specific warranty for a Product or service is provided by a third party, such as the manufacturer of the product or the original source from where the product originated, or a third-party service provider, any warranty claims related to such third-party warranties are solely between you and the third party. VK Furniture and Electronics will not be liable or responsible for any such third-party warranty. We do not have any obligation to mediate or resolve any disputes or disagreements that may arise between you and the third party regarding such warranties.

4. Governing Law & Jurisdiction: This Warranty Policy shall be governed by the laws applicable in the jurisdiction where VK Furniture and Electronics operates. Any disputes or claims arising from or related to this Warranty Policy shall be subject to the exclusive jurisdiction of the courts located in Mangalore, Karnataka.

5. Amendment: VK Furniture and Electronics reserves the right to modify or amend the terms and conditions of this Warranty Policy. Such modifications or amendments may be made due to changes in the availability of services, Products, or spare parts, or to comply with applicable policies, rules, regulations, and laws. VK Furniture and Electronics may make these changes with or without prior notice.

CANCELLATION, RETURN AND REFUND POLICY

We are committed to delivering the best customer experience to our Users, starting from the moment you place an order to initiating a return. When transacting on the vk-groups.com website, we strive to provide a hassle-free experience for returning the product you have ordered. You can rely on us as your preferred shopping destination. This cancellation, return, and refund policy ("Policy"), in conjunction with the Terms, outlines the procedures and policies we follow for accepting Product cancellations, processing returns, and issuing refunds.

1. APPLICABILITY OF POLICY

1.1 By using the VK-Groups platform and/or initiating a purchase request for Product(s) on vk-groups.com, you acknowledge and agree to be bound by the terms outlined in this Policy without any modifications. If you do not agree to the terms outlined in this Policy, we advise you not to proceed with any transactions on vk-groups.com.

1.2 Please be aware that we reserve the right to make changes to the terms of this Policy that govern your returns, refunds, or order cancellations for products on vk-groups.com. We recommend checking the Policy periodically to stay updated and ensure your understanding of the current terms and conditions that apply when using vk-groups.com.

5. TERMS FOR CANCELLATION, RETURN AND REFUND OF ORDERS

General Terms: VK Furniture and Electronics has the right to cancel any order without any explanation for doing so, under situations where VK is not able to meet the requirement of the order placed, or the order so placed/cancelled does not comply with the VK Retail policy, or for any other reason.

Cancellation of Products:

(a) Orders for Products can be cancelled within 24 hours from online purchase order made. No cancellation will be done after 24 hours including refund of payment. However, please note that once the production process has commenced or the Product has been shipped, cancellations are no longer possible.

(b)You can cancel the particular order of the product by referencing the unique identity number, which is used to track the status of delivery of purchase products, from us or you can send email to customercare@vkgroups.com.

(c) Upon receiving the cancellation request, we will promptly cancel the order and initiate the refund process for the Products. The refund will be processed within 7 (seven) business days from the receipt of the cancellation request from you or upon the pickup of the products, if applicable. The refund amount will be credited to you using the same mode of payment that was used for the original purchase. Please note that all refunds are subject to the applicable policies and charges of your bank or financial institution.

(d)For any customised or Made to Order product, the cancellation is required within 24 hours of placing the order. No cancellation will be approved after 24 hours of cancellation.

(e) The cancellation policies mentioned here may not be applicable to certain pin codes. To determine the specific cancellation policy for your delivery location, please enter your pin code in the designated box provided on the VK-Groups platform.

(d) The Product specific cancellation policy will be mentioned on the product listing page. The cancellation policy for third party Products will be mentioned on such Product listing page.

2.2 Return of Products

(a) You can request a return of the Product if any of the following conditions apply: (i)The Product is damaged (ii)Both the Product and shipping package have been damaged, (iii)The Product is defective or not in working condition, (iv)Parts of the Product or accessories are missing, or (v)The Product received is different from what was ordered based on the Product description provided on VK-Groups. Please ensure that you initiate the return request within 7 (seven) days from the date of receiving the Product ("Return Period").

(b) To ensure a successful return pick-up, please keep the Products in their unused, original condition. This includes retaining the original invoice/sales receipt, the brand's outer box, MRP tags, user manual, warranty cards, and original accessories in the manufacturer's packaging. We will consider accepting the request for return of such Products in accordance with the terms outlined in this Policy.

(b) To ensure a successful return pick-up, please keep the Products in their unused, original condition. This includes retaining the original invoice/sales receipt, the brand's outer box, MRP tags, user manual, warranty cards, and original accessories in the manufacturer's packaging. We will consider accepting the request for return of such Products in accordance with the terms outlined in this Policy

(c) If you have received a Product that is eligible for return according to this Policy, we recommend registering a return request on VK-Groups as soon as possible. We will then review the request at our discretion to determine the acceptability of the claimed defects, damages, or noncompliances in the Products. During the verification process, we may ask you to provide images of the damaged or defective Product or allow our personnel to schedule a visit to assess the damage, defect, or noncompliance. Based on the assessment report and our sole discretion, we will decide whether to accept or reject the return request. Once the damage or concern reported in the return request has been assessed, we will resolve the issue in a manner that we deem appropriate.

(d) In order for your return to be processed, you must fulfill the conditions stipulated by us at the time of returning the Products. These conditions include returning the Product in its original condition, with the price tag intact, including the original packaging, brand outer packaging, and all accessories that were included with the Product. Additionally, the Product should not have suffered any damage while in your possession after delivery.

(e) You acknowledge and agree that we will not accept the return of any Product under the following circumstances: (i) If you have placed an order for the wrong product model, color, or incorrect Product. (ii) If the Product belongs to a non-returnable Product category, such as personalized Products or made-to-order Products that are not suitable for return based on their nature. (iii) If you fail to request a return or register a complaint regarding the Product within the specified Return Period. Additionally, any damage to the Product caused by improper wearing or safekeeping, any modification or alteration to the Product by you or a third party, or any depreciation in the value of the Product for other reasons will not be considered a quality problem and will render the Product non-returnable. Any decision made by us in this regard shall be final and binding. (f) To initiate a return of the Product(s) purchased from us, the Product(s) must satisfy the following mandatory conditions: (i) The Product has not been used, cleaned, or tampered with by you. (ii) The price tag/barcode, brand tags, original packaging material, and accompanying accessories are intact and not altered, damaged, or discarded by you. (iii) The Product is not altered, unless a vendor defect is proven. (iv) The return is being initiated against the order under which it was bought and from the same account, and the serial number/barcode of the Product matches our records. (v) There is no foul odor, perfume, stains, dents, scratches, tears, or damage on the Product. (vi) If the Product(s) were bought as a set, they should be exchanged as a complete set. (vii) The Products returned should be in unused, undamaged, unwashed, and saleable condition.

(viii) We are satisfied that the Product has not been rendered defective or unusable. Please note that we reserve the right to reject a return request for a Product if it does not satisfy the aforementioned conditions. Please ensure that the Product(s) meet these mandatory conditions before initiating a return.

(g) To facilitate the return of purchased Products, we work with our reverselogistics partners. Once we receive your request for a return on VKF&E and acknowledge it, our reverse-logistics partners may contact you to arrange the collection of the purchased Products from your location. The purpose of this process is to ensure a smooth and convenient return experience for you. Our reverse-logistics partners will coordinate with you regarding the collection of the Products. Please ensure that you provide accurate and complete information during the return request process so that our reverse-logistics partners can contact you promptly and arrange for the collection of the Products.

(h) Please note that there may be variations in fabric color and wood finish between the images of the Product displayed on VK- Groups and the actual Product due to screen calibrations and resolutions. In such cases, the Products may not be eligible for return. We encourage you to carefully review the product descriptions and images before making a purchase. It is also important to ensure that you select the correct model, color, and specifications of the Product during the ordering process to avoid any issues. Taking the time to make an informed decision can help prevent buyer's remorse. If you have any concerns or questions about the color or finish of a specific Product, we recommend contacting our customer support team for assistance before making your purchase. We strive to provide accurate product information and a satisfactory shopping experience.

2.3 Refund

(a) When you request a return or cancel a product on VK-Groups, you have the option to seek a refund. Please note that a refund can only be processed if we have received the payment for the product from you.

(b) Upon verification and assessment of the returned products and associated documents, eligible refund amounts for cancelled or returned products will be processed within 7 business days. The refund will be issued once all stipulated conditions are met, including the product being returned in its original condition with intact price tags, original packaging, and accompanying accessories. Please note that ineligible products will not be eligible for a refund. The refund amount will be credited to the original payment method chosen by you. Please be aware that it may take additional time for the refund to be reflected in your account, depending on your financial institution or payment solution provider's terms and conditions.

(c) Please note that we do not provide cash refunds. The refund amount will be processed within 7 working days, depending on the payment method you have chosen. However, in some cases, it may take longer for banks or financial intermediaries to process the refund request. If the refund is not processed within the advised timeframe, please feel free to contact us, and we will assist you further.

(d) As per our refund policy, the refund amount to be made to the user will not include any amount paid towards shipping charges or other applicable charges. However, if a product has been delivered to you with a defect or damage (after verification and acceptance by us), we may refund the shipping charges to you. If you have received a non-returnable product in a damaged or defective condition, we will provide you with a refund after verifying and examining the damage or defect.

(e) We reserve the right to reject a refund request for a product if it does not meet the quality conditions specified in our policy. After assessing the returned product, if it is determined that the product does not satisfy the specified conditions, we may notify you and return the product to you without initiating a refund.

3. Price Disclaimer: Prices and availability are subject to change without notice. All prices reflected in the product page are in Indian Rupees with recent prices. Please be aware that this price may differ from the price shown for the Product when you first placed it in your shopping cart and may change after placing the order in the cart. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery. Price, as listed, is inclusive of all applicable taxes.

4. Force Majeure: VK will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond VK’s reasonable control.
